Court Strikes Humiliating Blow By Defining What a Trans Man Isn't

Advocates and supporters of the transgender community often ignore biology and science in deference to emotions and feelings when it comes to what specific or non-specific genders a trans-individual may choose to identify as.

Unfortunately for them, a high court in Germany just trumped their feelings with the science they refuse to acknowledge, and ruled that a man who has transitioned to be a woman can’t be listed as the “mother” on his/her/xir’s child’s birth certificate, according to TheBlaze.

The ruling stemmed from a 2012 case in which a transgender woman who used to be a man, but had donated sperm prior to the transition, wanted to be listed as a “mother” on the birth certificate after that sperm was eventually used to impregnate the person’s partner, and a child was born as a result.

Germany’s Federal Court of Justice, however, just upheld a lower court’s ruling against the plaintiff, due to the fact that German law held that only the woman who gave birth to the child could be listed as the “mother” on the birth certificate.

According to The Associated Press, the court ruled, “The transsexual person’s fundamental rights aren’t breached by the fact that existing ancestry law assigns her the legal status of parent according to her former sex and the specific contribution to procreation that resulted from this.”

In other words, the parent who donated the sperm that was used to create the baby must be listed as the “father” on the birth certificate. Pretty self-explanatory, at least for those of us who understand basic science and the fundamentals of biology.

German media outlet DW reported that the high court’s ruling aligned with a similar case in September in which the roles were reversed and a woman who had given birth to a child but then transitioned to be a male wanted to be declared the father, but was told she was still officially viewed as the mother.

That case has been appealed to Germany’s Constitutional Court for review.

As in that case, the court in this case ruled that even if a parent had legally changed their gender, such a change had no bearing on the legal relationship between the parent and their child.

Again, basic science is more important than feelings, at least in the eyes of the German court.

Unsurprisingly, advocates for the gay, lesbian and transgender community are outraged and are demanding the laws be changed to suit their whims.

The Lesbian and Gay Federation in Germany stated that this decision from the court made it clear that there needed to be reforms to the descent laws in the country.

They argued that the “legal recognition of the broad constellation of diversity of rainbow families must be guaranteed.”

The transgender community and those who support it think they can shift the culture to force everyone else to accept and abide by their particular lifestyle choices.

However, so long as the courts remain beholden to the law and fundamentals of nature which under-gird it, they are going to have a difficult time doing so.
